The contracts finalized through the site tenutadelcigno.it fall into the category of distance sales contracts, between Società Agricola Tenuta del Cigno srl. (hereinafter also referred to as the Company) with registered office in Via Pica 310, 41122, Modena, Italy, Registered Reg. Imp., CF and VAT no. 03755030362 Share Capital € 100.000,00 and the Consumer, and have as their object the purchase and sale of products through telematic selection on the tenutadelcigno.it website. The sale is governed by these Conditions which must be considered an integral and substantial part of the sales contract. Therefore, the Customer is invited, before sending the order, to carefully read the conditions of sale. The Company reserves the right to update these conditions of sale at any time, including for any regulatory adjustments and changes, and the changes will be effective from the date of publication on the tenutadelcigno.it website. A. MANAGEMENT OF PURCHASE ORDERS
The management of purchase orders takes place according to the following phases:

2) Acceptance of the order by Società Agricola Tenuta del Cigno srl sent to the Customer by e-mail containing the main information and the quantity of the product ordered, its price, the payment methods, the shipping method and the relative cost, the shipping address, billing information.
The acceptance and fulfillment of the order will take place only after the payment has been credited.
In the event that the quantity of the products ordered exceeds the availability of the Company, the Customer will be promptly informed by e-mail, so as to choose whether to replace the missing product, modify or cancel the order at no cost and the Company will reimburse the Customer the unpaid sum possibly already paid.
The Customer releases the Company from any liability deriving from any incorrect compilation of the order form, even in relation to the delivery address only and / or the issuance of incorrect tax documents, being the Customer solely responsible for the correct insertion of the data in the order form. Minors under the age of 18 are not authorized to place orders via the online order form.
B. SALE PRICES AND BILLING
The prices of the products displayed on the site are expressed in € (Euro) inclusive of VAT and any other taxes, containers and packaging. Shipping costs are not included. Any promotions relating to the sale price and / or shipping costs are valid only during the period of publication on the site. The shipment of the purchased items will take place the working day following the receipt of the order, while in case of payment by bank transfer in advance the working day following the crediting of the payment. The delivery of the ordered products will be made to the shipping address that the Customer has indicated when completing the order. Depending on the destination area, deliveries may take place over a period of time ranging from 2 to 10 days, except in cases of force majeure. In order to ensure timely delivery, it is advisable to indicate an address where couriers will surely find someone on delivery, and a telephone number to be easily contacted.
The user acknowledges that the withdrawal of the Product is his specific obligation deriving from the purchase contract. Only for Italy, for orders over € 100 the transport costs will be free.
Transport costs in foreign countries vary according to the destination and weight of the product, and range from a min. € 14 per 1 kg.

For delivery to countries not included in the list, the customer is requested to contact the company at email@example.com to find out about feasibility, costs, times and shipping methods.
The goods must be checked upon delivery and any damage must be reported to the courier.
F. RETURNS AND RIGHT OF WITHDRAWAL (pursuant to Legislative Decree 06/09/2005 n. 206)

These Conditions of Sale and the purchase and sale contracts finalized through the website tenutadelcigno.it are governed by Italian law having regard to the EEC directives (Legislative Decree 6/09/2005 n.206 Consumer Code - Legislative Decree 9/04/2003 n 70 - subsequent amendments and additions). The Customer relieves Società Agricola Tenuta del Cigno Srl from any liability relating to malfunctions, interruptions of services and degradation of performance, whether or not these are due to force majeure or unforeseeable circumstances, when they are not directly attributable to the same Company for its willful misconduct or gross negligence. For any dispute regarding the interpretation of these conditions of sale and the commercial relations deriving from them between the Company and the Customer, the Court of Modena will have sole jurisdiction.
