GENERAL CONDITIONS AND CONTRACTUAL TERMS OF SALE FOR THE WEBSITE WWW.TENUTADELCIGNO.COM
Contracts concluded through the tenutadelcigno.it website fall within the category of distance sales contracts, between Società Agricola Tenuta del Cigno srl. (hereinafter also referred to as the Company), with registered office at Via Pica 310, 41122, Modena, Italy, Company Register, Tax Code and VAT No. 03755030362, Share Capital €100.000,00, and the Consumer. Their purpose is the sale of products through online selection on the tenutadelcigno.it website. The sale is governed by these Conditions, which must be considered an integral and substantial part of the sales contract. Therefore, the Customer is invited to carefully read the conditions of sale before placing an order. The Company reserves the right to update these conditions of sale at any time, including to reflect any regulatory adjustments and changes, and the changes will be effective from the date of publication on the tenutadelcigno.it website. By submitting an electronic order form in the appropriate section of the website, the Customer accepts the terms and conditions of sale in force at that time and constitutes consent to the purchase, thus finalizing the sales contract.
A. PURCHASE ORDERS MANAGEMENT
Purchase order management occurs according to the following phases:
1) Sending of the order completed in the appropriate section of the site by the Customer.
2) Acceptance of the order by Società Agricola Tenuta del Cigno srl sent to the Customer via email containing the main information and quantity of the product ordered, its price, payment methods, shipping method and related cost, shipping address, and billing information.
Order acceptance and processing will only occur after payment has been credited.
In the event that the quantity of products ordered exceeds the Company's availability, the Customer will be promptly informed via email, allowing them to choose whether to replace the missing product, modify or cancel the order at no cost, and the Company will refund the Customer any undue sum already paid.
The Customer releases the Company from any liability arising from any incorrect completion of the order form, including the delivery address and/or the issuance of incorrect tax documents. The Customer is solely responsible for correctly entering the data on the order form. Persons under 18 are not authorized to place orders via the online order form.
B. SALES PRICES AND INVOICING
Product prices listed on the site are expressed in € (Euro) and include VAT and any other applicable taxes, containers, and packaging. Shipping costs are not included. Any promotions relating to the sale price and/or shipping costs are valid only during the period of publication on the site. Payment can only be made in € (Euro), and amounts will be shown on the invoice only in € (Euro). The invoice will be sent to the Customer at the email address provided during the order process.
C. SPECIAL OFFERS, DISCOUNT COUPONS AND FREE SHIPPING
The conditions relating to special offers, promotions, and discount coupons will be indicated from time to time on the tenutadelcigno.it website through specific communications.
D. PAYMENT METHODS
Payment can be made by credit card, PayPal, or advance bank transfer.
1) CREDIT CARD
Purchases made using a credit card are handled through the Cartasì circuit.
Accepted credit cards are: Visa, Mastercard, AMEX, Google Pay, Apple Pay.
Shipment will be made only after the bank has notified you of receipt of payment.
Società Agricola Tenuta del Cigno declares that users' information and payment card data will not be stored by the site or by the company.
2) BANK TRANSFER
When purchasing via advance bank transfer, to expedite shipping, please email the Company a copy of your bank receipt confirming the transfer to info@tenutadelcigno.com. Your order will be accepted and processed only after payment has been received, which must occur no later than 10 (ten) business days after placing the order. After this deadline, the order will no longer be valid and will be cancelled. The reason for payment for the bank transfer must include the name and surname or company name of the person placing the order, as well as the order number and date.

E. SHIPMENTS
Orders will be shipped the next business day after receiving your order, or the next business day after receiving your payment if you paid by advance bank transfer. Ordered products will be delivered to the shipping address you provided when placing your order. Depending on the destination area, deliveries may take 2 to 10 days, except in cases of force majeure. For information on shipments of large quantities (over 100 kg) or to countries not included in the list of foreign countries, please contact the Company directly at the following email address: info@tenutadelcigno.com to receive a personalized quote.
To ensure timely delivery, we recommend providing an address where the couriers will be sure to find someone to deliver the package, as well as a phone number where they can easily contact you.
The user acknowledges that collecting the Product is a specific obligation under the purchase contract. In the event of non-delivery due to the recipient's absence at the address specified in the order form, the courier will leave a card certifying the delivery attempt (so-called "delivery notification"). The card will include the telephone number the user must contact to request a subsequent delivery attempt.
The user will be able to indicate a shipping address alternative to the billing address and specify whether the order is gift wrapping.
Società Agricola Tenuta del Cigno srl reserves the right to use alternative carriers and/or delivery methods. In such cases, the change will be specified during the purchase process.
Due to international export sanctions, Società Agricola Tenuta del Cigno is unable to manage or organize shipments to the following territories:

TRANSPORTATION FEE
Shipping costs vary based on the destination country and the quantity purchased. They are calculated automatically, and you can check the exact amount directly in your virtual shopping cart when placing your order.
ITALY
Shipping costs to Italy start at €5,50.
For Italy only, shipping is free for orders over €100.
FOREIGN COUNTRIES
Shipping costs to foreign countries vary based on the destination and product weight, and range from a minimum of €14 per 1 kg.
Shipping costs will be calculated automatically, and you can check the exact amount directly in your virtual shopping cart.
For deliveries to countries not included in the list, the Customer is requested to contact the company at info@tenutadelcigno.com to find out about feasibility, costs, times and shipping methods.
The goods must be inspected upon delivery and any damage must be reported to the courier.
F. RETURNS AND RIGHT OF WITHDRAWAL (pursuant to Legislative Decree 06/09/2005 n. 206)
In the event that the end consumer is dissatisfied with the purchased products, they may exercise their right of withdrawal by notifying Società Agricola Tenuta del Cigno Srl, with registered office at Via Armando Pica 310, 41126, Modena, Italy, via registered mail within 14 days of receiving the purchased products. The end consumer is invited to send such notification in advance to info@tenutadelcigno.com, providing the purchase order details. The purchased products must be returned to our office within 14 days of receipt. Subject to inspection of the goods, the Company will refund the sums paid as soon as possible, and in any case no later than 30 days after receiving the withdrawal notice. The returned products must reach the Company's office intact, in their original packaging complete with all its parts, as received by the Customer. The return of the purchased products is the responsibility and expense of the Customer in accordance with Article 67.
G. APPLICABLE LAW
These Terms of Sale and the sales contracts finalized through the tenutadelcigno.it website are governed by Italian law in accordance with EEC directives (Legislative Decree 6/09/2005 n. 206 Consumer Code – Legislative Decree 9/04/2003 n. 70 – subsequent amendments and additions). The Customer releases Società Agricola Tenuta del Cigno Srl from any liability relating to malfunctions, service interruptions, and degradation of performance, whether or not due to force majeure or unforeseeable circumstances, when they are not directly attributable to the Company itself due to its willful misconduct or gross negligence. Any dispute regarding the interpretation of these Terms of Sale and the commercial relationships arising therefrom between the Company and the Customer shall be subject to the exclusive jurisdiction of the Court of Modena.
